Modification of measures after the divorce judgement
After a separation or divorce, a series of measures are adopted that regulate the financial relations between the spouses or between them and the children.
These measures adopted on the basis of certain facts at the time of the break-up may vary over time, so that if this happens, it will be possible to initiate proceedings to modify the measures in order to adapt them to the current situation.
The modification of the measures can be carried out by mutual agreement or in a contentious manner.
Requirements for modification of divorce or separation measures
The requirements to be able to resort to this procedure include an alteration of the circumstances that is relevant, understanding by relevance transcendental, fundamental alterations and not of little or relative importance.
The alteration must also be permanent, not temporary, and beyond the unilateral will of the person claiming the modification.
This alteration must be accredited in an unquestionable manner before the judicial authority, which is why it is essential to have good advice that allows us to present it in the most appropriate manner before the judge.
