We would like to remind you of some tips and documents that will be necessary in case of death, which will be handled by our Inheritance Lawyers online, in order to process the Inheritance:
1) The death certificate
This is a document issued by the Civil Registry Office, without it we will not be able to carry out any formalities.

2.- Certificate of last will and testament
This is the document we will need to know the inheritance of your family member, we will need:
Details of the applicant.
Details of the deceased (name, surname, date of death, place of death, date of birth, place of birth, etc.).
3.- Is there a Will?
Once the certificate of last will and testament has been requested, we will know if there is a will or not.
In such circumstances, our Inheritance Lawyers will provide you with two solutions:
1. Inheritance WITHOUT a will: Declaration of heirs, notarial or judicial
The declaration of heirs will be Notarial when the heirs are children, grandchildren or direct descendants of the deceased, parents or direct ascendants and also the widowed spouse.
The declaration of heirs must be judicial when the heirs are collateral relatives, i.e. siblings, nephews, nieces and nephews.
Declaration of heirs before a notary. This is called the Act of Declaration of Intestate Heirs.
For the declaration of heirs before a notary we need:
Original DNI of the deceased.
Death certificate.
Certificate of last will and testament.
Family record book
2 witnesses who knew the deceased and have no interest in the inheritance.
2.- Inheritance WITH a will: We must make an inventory and list of assets to be included in the inheritance.

4.- Payment of Taxes
Remember that inheritance tax must be settled within five months, although there is the possibility of requesting an extension as long as this is done within the fifth month.
In Madrid, this extension can be requested at the Community of Madrid, Directorate General of Taxes or at any Registry Office of the Community of Madrid.
Also remember that if there is real estate you will have to pay the Tax on the Increase in Value of Urban Land (formerly known as "plusvalía").
5- Registration in the Registers
Registration of all partition operations in the corresponding Land Registers.
