Non-binding nature of the compensation offer
The offer of compensation for unfair dismissal is non-binding
As we are informed by our Employment Lawyers in our Madrid office, according to the judgement of the Supreme Court of 18 December 2009, if the worker has been offered the recognition of unfair dismissal and a certain compensation, which he has not accepted and opts to open the process, what he cannot expect is that what he has been offered to avoid the lawsuit is maintained in this one.
