"What kind of lawyer do I need? This is a question that many people ask themselves when they need to obtain specific advice or face legal proceedings of any kind. Not all lawyers are the same and choosing the right one can mean the difference between success and failure. Therefore, here we would like to talk to you about the different types of lawyers you can find at your disposal.
What type of lawyer do I need: Main types of lawyers
Criminal lawyers
These are lawyers specialising in criminal law. Their work consists of assisting and defending the interests of a person who has allegedly committed or suffered a criminal offence under the Criminal Code. Their work focuses on the pre-trial and trial phases and can be of two types:
- When defending the injured party: filing the complaint or lawsuit and appearing as the prosecution.
- When defending the offending party: defence of the client seeking acquittal or agreements to limit the sentence.
The work of these types of lawyers is usually carried out in the Criminal Courts, in the Provincial Court and, in very specific cases, in the National Court.
Civil lawyers
These are the different types of lawyers who specialise in civil law, i.e. the law that appears in our Civil Code. Generally speaking, their work deals with disputes between private interests, whether they are individuals or legal entities. Their work is carried out in the Courts of First Instance and in the Provincial Court and usually refers to claims for monetary debts, divorce, incapacitation, inheritance and a long etcetera.
However, Civil Law is so broad that, within it, we can find different types of civil lawyers. Here are some examples:
Family Lawyers
They specialise in family law, a sub-branch of civil law. They are the ones to turn to in the event of having to deal with a separation or divorce, as well as any effects derived from these processes. We are talking, for example, about the management of the children's visiting arrangements and possible breaches, the taking of provisional measures in this respect, etc.
Property lawyers: what is known as property law also falls under civil law. Lawyers specialising in this area are responsible for defending the interests of an individual in cases of evictions, application of floor clauses, foreclosures, etc.
Employment lawyers
Among the different types of lawyers, those who specialise in labour and social security law are known as labour lawyers. Specifically, their function is to intervene when conflicts arise between workers and public administrations (generally, the National Institute of Social Security, the State Public Employment Service or the General Treasury of Social Security) or between workers and private companies.
The work of labour lawyers is usually focused on defending the interests of clients who are victims of accidents at work, mobbing, substantial changes in their working conditions, non-payment and claims for wages, etc. Their most common areas of work are the Social Courts and the High Courts of Justice.
Administrative lawyers
Administrative lawyers, also known as administrative lawyers or administrative lawyers, are those who intervene in proceedings brought by companies or individuals against one or more bodies of the Public Administration or vice versa. They have the task of making allegations, appeals or appeals for reconsideration and, finally, representing the interested party in legal proceedings within the contentious-administrative route.
Within this branch we can also find other types of lawyers. The most notorious case is that of tax lawyers, who specialise in financial and tax law. It is obvious that the issues they usually deal with have a lot to do with administrative law.
In fact, the work of tax lawyers usually has to do with fees, taxes and duties that must be paid to the Public Administration. Moreover, their advisory role is as important, if not more so, than their acting role. This is the reason why many people put themselves in their hands when it comes to knowing how to deal with the tax authorities and being subject to penalties. Within the judicial field, they focus on processes related to the contentious-administrative route.
Commercial lawyers
The last type of lawyer we are going to talk about. As is obvious, they specialise in commercial law, i.e. the law that regulates relations between companies. The work of these professionals is not limited, solely and exclusively, to the judicial sphere, which is carried out in the Commercial Courts or in the Courts of First Instance, but is also fundamental in the drafting of contracts, in merger processes between companies, in the agreements reached in the shareholders' meetings of large companies or in negotiations between different companies.
In addition, they are also responsible for representing companies and workers in bankruptcy proceedings and redundancy procedures. These were very common in the years of the crisis and continue to have a high impact in today's world of work.
Conclusions on the different types of lawyers
As you will have seen, law is a very broad discipline that requires its professionals to specialise in certain branches in order to provide an adequate service to their clients. Therefore, if you have to face a legal process of any kind or simply need to receive professional and appropriate advice on a specific matter, take heed of what we have told you here and put yourself in the hands of a lawyer specialised in matters such as the one that concerns you. This is the only way you can be sure that your interests will be defended accurately and honestly.
